These Terms of Service apply to the Markevix website and services, the Markevix Games app development and publishing activity, and the Guess The Emoji app, including related content, features, support, and any project or service relationship with us.
By using this website, submitting an enquiry, engaging Markevix for services, downloading or using the Guess The Emoji app, or otherwise interacting with our products and services, you agree to these Terms of Service. If you do not agree with any part of these Terms, do not use the website, services, or app.
These Terms cover two parts of our business: the Markevix digital services business and the Guess The Emoji mobile app. If a separate written proposal, statement of work, app store terms, or platform policy applies to a specific service or feature, that document may supplement these Terms to the extent it does not conflict with them.
You must be old enough to form a binding contract in your location to use the website, engage our services, or use the app. If you use the website, services, or app on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
Markevix provides digital growth services including website design, website development, SEO, social media marketing, Shopify e-commerce, mobile app development, influencer marketing, and AI automation. The exact scope of work for each project is defined in the proposal, estimate, message exchange, or written agreement for that project.
We will make reasonable efforts to deliver the agreed work based on the approved scope, timeline, and budget. Any work outside the agreed scope may require a revised estimate, additional timeline, or a separate agreement.
When you engage Markevix for services, you agree to provide accurate project details, timely feedback, approvals, access credentials, and any content or assets needed to complete the work. Delays in sharing required inputs may affect timelines and delivery dates.
Payment terms are defined in the proposal or invoice for each project. Unless otherwise agreed in writing, work may be paused until required advance payments or milestone payments are received. Any third-party costs, platform fees, or paid tools needed for a project are the client’s responsibility unless we agree otherwise in writing.
For app-store purchases, subscriptions, or digital items tied to the Guess The Emoji app, the applicable app store or payment provider may also set its own billing, refund, and subscription terms.
We may include a reasonable number of revisions as part of the agreed scope. Final approval from the client means the work is considered accepted for that stage, and later changes may be treated as additional work.
Guess The Emoji is a casual puzzle game published or supported by Markevix Games. The app may include puzzles, daily challenges, rewards, leaderboards, cosmetics, in-app purchases, ads, and other game features.
We may update, change, suspend, or discontinue any part of the app at any time, with or without notice, unless applicable law requires otherwise.
Some app features may use a device-based or player-based identifier to save progress, sync content, restore purchases, or support analytics and fraud prevention. You are responsible for keeping any account credentials or device access secure and for all activity associated with your account or device.
If the app, website, or any related service allows you to enter text, profile information, usernames, images, or similar content, you are responsible for that content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, and use that content only as necessary to operate, improve, and provide the website, services, or app.
You agree not to submit content that is illegal, harmful, infringing, misleading, abusive, harassing, obscene, or otherwise objectionable.
You agree that you will not use the website, our services, or the app in any way that violates applicable law, reverse engineer or decompile software except where permitted by law, interfere with or disrupt our systems, use bots or cheats, attempt to bypass purchase or access controls, or copy or commercially exploit our content except as expressly allowed.

Purchases are generally processed by the applicable app store or payment provider. Virtual items and digital rewards have no real-world monetary value unless required by law or platform policy.

We will treat project information shared with us as confidential where reasonably appropriate. We may disclose information only when needed to deliver the service, comply with law, work with trusted vendors, or operate the app and website under similar confidentiality expectations.
We may suspend or terminate access to the website, services, or app at any time if we believe you have violated these Terms, if we discontinue a product or feature, or if we are required to do so for legal or security reasons.
The website, services, and app are provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Markevix, Markevix Games, and their affiliates, directors, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or use arising out of or related to your use of the website, services, or app.
To the extent liability cannot be excluded, our total liability will be limited to the amount you paid to use the app or service in the 12 months before the claim arose, or the minimum amount permitted by law, whichever is greater.
You agree to indemnify and hold harmless Markevix and Markevix Games from claims, damages, losses, liabilities, and expenses arising out of your violation of these Terms or misuse of the website, services, or app.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date. Your continued use of the website, services, or app after the updated Terms become effective means you accept the updated Terms.
These Terms are governed by the laws applicable in India, and where permitted, the courts in Delhi will have jurisdiction over disputes arising from these Terms, unless a mandatory consumer, app store, or platform rule requires a different process.
